Cause of action

１ 当該建設業者は、労働安全衛生法（昭和47年法律第57号）に違反した行為が建設業法第28条第１項第３号に該当するとして、平成31年４月26日付で同項の規定による処分（指示処分）を受けた。 ２ 当該建設業者は、大阪市大正区南恩加島七丁目１番82号に本店を、大阪府泉大津市内に汐見ヤードを置いて、産業廃棄物の収集・処理業を営む事業者であり、当該建設業者の取締役として、同ヤードにおいて作業する労働者を指揮監督するとともに同労働者の安全を管理するものが、当該建設業者の業務に関し、令和４年１月27日、当該建設業者の汐見ヤードにおいて、当該建設業者の労働者をして車両系建設機械であるドラグ・ショベルを用いて再生砕石の掘削作業を行わせるに際し、あらかじめ、当該作業に係る場所について地形、地質の状態等の調査により知り得たところに適応する車両系建設機械による作業の方法等が示された作業計画を定めず、もって機械等による危険を防止するための必要な措置を講じなかったものである。このことで、当該建設業者の取締役は、労働安全衛生法違反により、罰金20万円の刑に処せられ、令和４年10月４日にその刑が確定し、当該建設業者は、同法違反により、罰金30万円の刑に処せられ、同月12日にその刑が確定した。 ３ 当該建設業者の２の労働安全衛生法に違反した行為は、１の指示処分に違反する。
