新潟県が発注した施設第５号上越警察署（仮称）大潟交番改築工事において、西田建設株式会社（以下、「元請負人」とする。）は元請負人である。 元請負人は令和４年10月26日、同社現場代理人が、法定の除外理由がないにもかかわらず、同工事において二次下請負人の労働者に高さ２m以上の作業床を使用させる際、墜落により労働者に危険を及ぼす恐れがあるところに囲い、手すり、覆い等を設けず、二次下請負人の労働者の労働災害を防止するために必要な措置を講じなかった。 このことを原因とし、元請負人及び同社現場代理人が労働安全衛生法違反により、高田簡易裁判所から罰金刑を受け、令和５年３月25日にこの刑が確定している。 このことが、建設業法第28条第１項第３号に該当する。
