株式会社たなか商会の代表取締役であった者が刑法第204条の規定により平成31年１月25日付けで罰金刑が確定した。上記の事実があったにも関わらず平成31年３月19日付け建設業許可申請（業種の追加）及び令和３年７月15日付け建設業許可申請（更新）において、欠格要件に該当しない旨を記載した誓約書（様式第６号）及び当該代表取締役が賞罰を受けていない旨を記載した法人役員の住所、生年月日等に関する調書（様式第１２号）を提出し、不正に建設業許可を取得した。このことは、建設業法第２９条第１項第７号に該当する。
