On September 29, 2020, at a construction site in Itabashi, Tokyo, operated directly by Taro Construction Co., Ltd., a wall collapsed near the site, causing a worker to be buried and resulting in his death. When performing excavation work near the wall, there was a risk of damage to the wall that could endanger workers. The company was required to reinforce the wall and take safety measures before proceeding with such work. However, it conducted the work without implementing these measures, leading to a violation of the Industrial Safety and Health Act. On April 11, 2022, the Tokyo Summary Court issued a summary order for violation of the Act, imposing a fine of 200,000 yen, which was finalized. This incident is recognized as a violation of the Construction Business Act Article 28, Paragraph 1, Item 3. The Kanto Regional Development Bureau issued an instruction requiring the company to take necessary safety measures, improve safety management, and conduct ongoing training to prevent recurrence. The company holds a construction permit (Minister of Land, Infrastructure, Transport and Tourism Permit No. 21354, Special-30).

Cause of action

太郎建設（株）が発注者から直接請け負った東京都板橋区におけるよう壁工事において、令和２年９月２９日、近接するよう壁が倒壊し、下敷きになった元請の労働者１名が死亡する事故が発生した。 よう壁に近接する箇所で明り掘削の作業を行う場合、同工事現場の西側に接地してあるよう壁の損壊等により労働者に危険を及ぼすおそれがあるので、同よう壁を補強する等当該危険を防止するための措置を講じた後でなければ作業を行ってはいけないところ、同措置を講じないまま同作業を行ったものとして、同社が令和４年４月１１日に東京簡易裁判所より労働安全衛生法違反で略式命令（罰金２０万円）を受け、その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
