Fukuda Construction Co., Ltd. was the prime contractor for the new office building construction in Miwa Town, Kumamoto Prefecture. The company's representative, Kenichiro Azuma, conspired with the president of the primary subcontractor and two employees to submit a false labor injury report to the Kumamoto Labor Standards Inspection Office on November 24, 2020. The report falsely stated that a worker had fallen from a 3.8-meter-high steel frame at the construction site, resulting in injuries and a leave of more than four days, despite the worker having fallen and been injured while working inside the subcontractor’s factory on the same day. As a result, the Kumamoto District Court issued summary orders imposing a fine of 200,000 yen on Fukuda Construction and 100,000 yen on the company's representative for violations of the Industrial Safety and Health Act, and these penalties were finalized. This conduct is recognized as a violation of Construction Business Act, Article 28, Paragraph 1, Item 3.

株式会社双葉建設は、御船町内における社屋事務所の新築工事の元請として工事を行っていたものであるが、同社代表取締役は、一次下請会社の代表取締役及び同社従業員の2名と共謀の上、両社の業務に関し、令和2年（2020年）11月24日、熊本労働基準監督署において、同署長に対し、真実は、一次下請会社の労働者が、同月11日、同工事現場において、高さ3.8メートルの鉄骨上で作業中に同所から地面に墜落したことにより骨盤骨折等を負い、同日から4日以上休業したにもかかわらず、同人が、同日、一次下請会社工場内において作業中に墜落し負傷した旨の虚偽の事実を記載した労働者死傷病報告書を提出し、もって労働基準監督署長に虚偽の報告をした。 この件に関し、熊本簡易裁判所から労働安全衛生法違反により株式会社双葉建設に対し罰金20万円、同社代表取締役に対し罰金10万円の略式命令があり、その刑が確定した。 このことが、建設業法第28条第1項第3号に該当すると認められる。
