Koshinawa Construction Co., Ltd., acting as the lead contractor for a demolition project of an old furnace facility in Kiso Town, Nagano Prefecture, directly contracted from the Kiso Wide Area Union, was involved in a fatal accident on January 20, 2021. During demolition work, a subcontracted worker used the third-floor corridor as a work platform and dropped debris through a missing section of the guardrail, resulting in a fall from approximately 9.3 meters and death. Despite the risk of fall from the missing guardrail, the company did not install barriers, guardrails, or coverings to prevent such falls. Consequently, the company and one employee were issued a summary order on December 15, 2021, by the Kiso Fukushima Summary Court for violations of the Labor Safety and Health Act, each fined 300,000 yen, with the penalties finalized. This constitutes a violation under Article 28, Paragraph 1, Item 3 of the Building Industry Act.

Cause of action

神稲建設株式会社が木曽広域連合から共同企業体の代表者として直接請け負った、長野県木曽郡木曽町における旧炉施設解体工事において、令和３年１月２０日、解体作業中に、下請負人の労働者が本工事現場３階通路を作業床とし、同通路の手すりの欠損部分から廃材を投下する作業を行っていたところ、同通路の手すり欠損部分から高さ約９．３ｍ下の１階床に墜落し死亡した。 この事故をうけ、手すりの欠損部分からの墜落により労働者に危険を及ぼす恐れがあったのに、手すりの欠損部分に囲い、手すり、覆い等を設けず、もって請負人の労働者の労働災害を防止するため必要な措置を講じなかったとして、同社及び同社社員１名が、令和３年１２月１５日、木曽福島簡易裁判所より労働安全衛生法違反による略式命令（それぞれ罰金３０万円）を受け、その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
