Cause of action

（株）山口建設は、令和元年5月14日、1次下請として入場する長崎県諫早市貝津町地内の一般県道諫早外環状線道路改良工事（河川1号橋Ｐ1）において、長崎県諫早市小野島町の同社の資材置き場で、足場の部材を移動式クレーンの荷台から降ろす作業に従事していた被災者が、約2カ月間の休業を要する右橈骨遠位端骨骨折の負傷をし、4日以上休業となったのであるから、遅滞なく所轄の諫早労働基準監督署長に対し労働者死傷病報告を提出しなければならないのに、約2年1カ月経過した令和3年6月22日に同報告を行い、もって法令の定める報告を遅滞なく行わなかった。 このことにより、簡易裁判所より、㈱山口建設及び同社代表取締役は労働安全衛生法違反により、それぞれ罰金20万円の略式命令を受け、令和4年1月5日にその刑が確定した。 このことが、建設業法第28条第1項第3号に該当し、監督処分の対象となる。
