当該建設業者は、他の事業者と共同して、日本年金機構が発注する特定データプリントサービス（※）について、遅くとも平成28年５月６日から令和元年10月７日までの間、受注予定者を決定し、受注予定者が受注できるようにすることにより、公共の利益に反して、特定データプリントサービスの取引分野における競争を実質的に制限していた。この行為が私的独占の禁止及び公正取引の確保に関する法律（昭和22年法律第54号）第２条第６項に規定する不当な取引制限に該当し、同法第３条の規定に違反するものとして、公正取引委員会から令和４年３月３日に同法第７条第２項の規定に基づく排除措置命令及び同法第７条の２第１項の規定に基づく課徴金納付命令（課徴金減免制度の適用30%）を受け、当該命令が確定した。 ※「特定データプリントサービス」とは、日本年金機構が一般競争入札等の方法により発注する「ねんきん定期便の作成及び発送準備業務（直近１年間通知者用）」等の22業務に係るデータプリントサービス（発注者から発注者の顧客のデータを預かり、データの編集・加工、印刷・印字、封入・封かん、発送準備などを行う業務）をいう。
