令和３年３月３日、大垣市発注「令和２年度契約第591号道路維持工事（大垣市禾森町２丁目141番地先）」の現場において、(株)木村建材の労働者が、同社所属労働者の運転するドラグショベルに右足を踏まれ、休業見込み２ヶ月以上を要する、右リスフラン関節脱臼骨折などの傷害を負ったことに関し、令和３年３月16日、大垣労働基準監督署長に対し、上記災害事案と異なる虚偽の報告をしたとして、同社及び同社の代表取締役が、令和４年１月７日に大垣簡易裁判所から労働安全衛生法違反により、同社に罰金20万円及び代表取締役に罰金20万円の略式命令を受け、その刑が確定している。 このことが、建設業法第28条第１項第３号に該当すると認められる。
