（株）みなみは、太宰府市発注の土木工事において、当時、建設業法第３条第１項の許可を受けないで建設業を営む上村総合建設（株）と、同法施行令第１条の２第１項で定める軽微な建設工事の範囲を超えて、下請契約を締結した。以上のことは、建設業法第28条第１項第６号に該当する。
