On December 27, 2021, on a farm in Kōzushima, Tokyo, officers of Umeda Construction Co., Ltd. lifted and rotated a water collection basin using a drag shovel to install it. During this operation, part of the ground collapsed, causing the drag shovel to tilt. A worker guiding the basin was caught between the arm of the drag shovel and a road retaining wall and died. The drag shovel was equipped with crane functions but was not switched to the appropriate operation mode. As a result, on November 9, 2022, the Tokyo Summary Court issued a summary order imposing fines on the company for violations of the Industrial Safety and Health Act, and on its officers for violations of the same Act and for occupational negligent homicide, with all penalties finalized. This constitutes a violation of Article 28, Paragraph 1, Item 3, and Paragraph 3 of the Building Business Act.

令和３年12月27日東京都神津島の畑において有限会社梅田工務店の役員は集水桝の設置を行うためこれをドラグ・ショベルでつり上げて旋回し降下させたところ、地盤が一部崩れてドラグ・ショベルが傾き、集水桝の誘導を行っていた者がドラグ・ショベルのアームと道路擁壁の間に頭部を挟まれて死亡した。なお、ドラグ・ショベルはクレーン機能が付いていたが、運転モードの切り替えを行っていなかった。 このことにより令和４年11月９日に東京簡易裁判所から、同社は労働安全衛生法違反、同社の役員は労働安全衛生法違反及び業務上過失致死罪により、それぞれ罰金刑の略式命令を受け、いずれもその刑が確定した。 このことが、建設業法第28条１項３号及び同条第３項に該当する。
