株式会社マルナカ工業は、令和２年10月29日 一 同会社の資材置場において、法令で定める資格を有しない労働者に、最大荷重が１トン以上のフォークリフトの運転の業務に就かせた。 二 その結果、同法人の労働者１名が負傷をし、４日以上休業することになったが、函館労働基準監督署長に対し、遅滞なく報告（労働者死傷病報告）を提出しなければならないところ、法令の定める報告を怠った。 その後、上記の違法行為が発覚し、令和４年７日１日に函館簡易裁判所において労働安全衛生法違反により同法人及び同法人役員が罰金刑を受け確定した。 このことは、建設業法第28条第１項第３号に該当すると認められる。
