1 当該建設業者は、2のとおり、大阪市内の民間発注工事（以下、「本件工事」という。）において、本件工事に係る発注者と株式会社日本ベンダーとの請負代金が建設業法施行令第１条の２に定める金額以上となることを知りながら、建設業法第３条第１項の規定に違反して同項の許可を受けないで建設業を営む株式会社日本ベンダーと下請契約を締結した。 ２ 本件工事の契約当時、当該建設業者の代表取締役である者が株式会社日本ベンダーの取締役でもあったところ、本件工事のうち、内装仕上工事等及び大工工事等については、当該建設業者から注文を受けて施工したAから3,255,780円、Bから551,430円（材料費を含まず。）、それぞれ当該工事代金の請求が当該建設業者に対して行われた。これらの金額に当該建設業者が自ら施工した管工事等に係る施工費用及び給湯器、排水ネット、水栓、バスパネルなどの材料費を加えると、500万円以上となる状態であった。本件工事全体のコスト管理も当該建設業者が行っていた。
