This legal action was based on the failure to implement necessary fall prevention measures such as installing safety nets or using fall arrest equipment. The incident and subsequent court ruling are recognized as a violation of Article 28, Paragraph 1, Item 3 of the Building Business Act.

令和３年３月３日、「佐久間様邸解体工事現場（大垣市赤坂町4017番地1）」において、同現場で(有) J‘ｓ ｗｏｒｋｓの労働者が家屋の屋根の上でカラーベストの剥離作業に従事していたところ、高さ約３．５メートルの屋根から墜落し、頸椎骨折などの重傷を負ったことに関し、労働者の危険を防止するために必要な措置（防網張り、要求性能墜落制止用器具を使用させる等の墜落防止措置）を講じなかったとして、(有) J‘ｓ ｗｏｒｋｓ及び同社の現場責任者が、令和３年９月２９日に大垣簡易裁判所から労働安全衛生法違反及び業務上過失傷害により、同社に罰金２０万円及び現場責任者に罰金３０万円の略式命令を受け、その刑が確定した。 このことが、建設業法第２８条第１項第３号に該当すると認めらる。
