（株）金子組は姫野組・大竹組 緊急地方道路整備工事 共同企業体が元請負人である徳島県阿南市福井町の由岐大西線緊急地方道路整備工事色面トンネルのうち、掘削工事の二次下請負として工事を請け負っていた。 当該工事現場において、令和４年１２月１３日、同社の労働者が支保工の固定作業中、倒れてきた支保工に左足を挟まれる労働災害が発生したにも関わらず、同社の現場代理人は、これを偽り、同工事において、支保工荷ぶれが労働者の左足に接触した旨の虚偽の事実を記載した労働死傷病報告書を労働基準監督署に提出し、もって虚偽の報告を行った。 本件について、同社及び同社現場代理人は令和５年７月２６日に、阿南簡易裁判所より労働安全衛生法違反で略式命令（罰金刑）を受け、その刑が確定している。 このことが建設業法第２８条第１項第３号に該当すると認められる。
