令和２年11月６日、東京都荒川区内の工事において、一次下請人の労働者に、通路及び作業用に設けた高さ2.7メートルの足場上で作業を行わせるに当たり、当該労働者が墜落する災害が発生し、足場の一部に手すりを設ける等の墜落防止措置を講じていなかった。 以上のことが、労働安全衛生法第31条第１項、第119条第１号及び第122条並びに労働安全衛生規則第563条第１項第３号及び第655条第１項第３号に違反し、株式会社進興工業社及び同社従業員が罰金刑に処せられた。 このことが、法第28条第１項第３号に該当する。
