株式会社フジミヤ及び同社代表取締役は、株式会社フジミヤ仮設事業部の資材置場において、足場材の積み下ろし作業を行うに当たり、法令の定めるフォークリフトの運転資格を有しない同会社の労働者に、最大荷重が2.3トンのフォークリフトの運転の業務に就かせたものである。この際労働者が積み荷である崩れた足場材の下敷きとなり、頭蓋骨骨折の重傷を負った。 このことにより、株式会社フジミヤ及び同社代表取締役は労働安全衛生法違反により、各々罰金20万円の略式命令を受け、その刑が確定した。 このことは、建設業法第28条第１項第３号に該当する。
