株式会社服部工務店が請け負った愛知県豊明市大久伝町地内の工場大規模改修工事の現場代理人は、同社の業務に関し、法定の除外事由がないのに、令和2年9月19日、同工事現場において、二次下請負人の労働者に、同所に設けたくさび式足場を作業床として使用させて、鉄骨の塗装作業を行わせるに当たり、同足場は地上から高さ約5.67メートルの高さに位置し、墜落により労働者に危険を及ぼすおそれがあったのであるから、同足場に、手すり等及び中桟等を設けるなどその危険を防止するため必要な措置を講じなければならなかったのに、その措置を講じないで同人に前記作業を行わせ、もって請負人の労働者の労働災害を防止するため必要な措置を講じなかったものである。 このことが、労働安全衛生法に違反し、名古屋簡易裁判所より、法人及び現場代理人が罰金30万円の略式命令を受け、その刑が確定した。 これは、建設業法第28条第1項第3号に該当する。
