Violating Article 22, Paragraph 2: The company violated this provision by collectively subcontracting work from Asahi Giken Co., Ltd., contrary to the regulations.

１ 施工体制台帳等の不作成等 当該建設業者は、大阪市発注の工事（以下「Ａ工事」という。）において、その請け負った建設工事を、株式会社トーワ技研工業に直接請け負わせていたにもかかわらず、建設業法第24条の８第１項及び第４項の規定に違反して、その請け負った建設工事を株式会社トーワ技研工業には直接請け負わせていないとする虚偽の施工体制台帳及び施工体系図を作成した。 ２ 一括下請負 （１）Ａ工事 当該建設業者は、Ａ工事において、１のとおり、真実の施工体制台帳等を作成しないなど、建設業法第22条第１項の規定に違反して、その請け負った建設工事を一括して株式会社トーワ技研工業に請け負わせた。 （２）Ｂ工事 ア 一括下請負（建設業法第22条第１項違反） 当該建設業者は、大阪市発注の工事（以下「Ｂ工事」という。）において、建設業法第26条第３項の規定に違反して、別の工事現場に専任の監理技術者として配置されたＣ氏を工事現場に専任の主任技術者として配置するなど、適格な主任技術者を配置せず、建設業法第22条第１項の規定に違反して、その請け負った建設工事を一括して株式会社トーワ技研工業に請け負わせた。 イ 一括下請負（建設業法第22条第２項違反） 当該建設業者は、Ｂ工事において、建設業法第22条第２項の規定に違反して、旭技建株式会社から同社の請け負った建設工事を一括して請け負った。
