当該建設業を営む者は、東大阪市内の民間発注の工事において、耐火被膜・ウレタン吹付工、内装工事（軽鉄・ボード貼工事）、シャワーユニット施工、内装工事（ポストフォーム取付工事）、OAフロアー工事、トイレブース工事、シーリング工事、ステン框取付け工事、軒天増減工事、シーリング工事（玄関ホール）、軒天・シーリング追加工事等の建設工事（内装仕上工事等）を請け負うなど、建設業法第３条第１項の規定に違反して同項の許可を受けないで請負代金が建設業法施行令第１条の２に定める金額以上となる建設工事を植村建設から請け負った。
