池村建設株式会社の元取締役は、自社倉庫解体で発生した廃棄物である木くず等約99.5 ㎏を、島田市横岡新田の田で焼却したことにより起訴され、廃棄物の処理及び清掃に関する法律等に基づき罰金40万円の有罪判決を受け、その刑が確定した。このことが、建設業法第28条第１項第３号に該当すると認められる。
