The company also inflated the total completion amounts by duplicating figures across evaluations, violating Articles 26-2 and 26-4 of the Building Business Act. The resulting evaluation reports were submitted to Sakai City and used for qualification assessments for public pipe work projects, which the company won.

当該建設業者は、滋賀県蒲生郡日野町内の民間発注の工事おいて、建設業法第７条第２号及び第26条第３項の規定に違反して、令和２年12月４日から令和３年１月30日までの間及び令和４年12月19日から同月31日までの間、同号に規定する貴社の営業所における専任技術者である者を、専任を要する主任技術者として工事現場に配置した。 当該建設業者は、福島県双葉郡楢葉町内の民間発注の工事において、建設業法第７条第２号及び第26条第３項の規定に違反して、令和２年９月から令和３年３月までの間、同号に規定する貴社の営業所における専任技術者である者を、専任を要する主任技術者として工事現場に配置した。 当該建設業者は、堺市発注の公共工事において、建設業法第７条第２号及び第26条第３項の規定に違反して、令和４年１月24日から同年５月31日までの間、同号に規定する貴社の営業所における専任技術者であり、かつ、当該工期の重複する期間に複数の民間発注の建設工事に主任技術者として配置した者を、専任を要する主任技術者として工事現場に配置した。 当該建設業者は、工事現場の職務に従事しながら実質的に営業所の職務にも従事しうる程度には工事現場と営業所が近接していない複数の民間発注の建設工事等において、建設業法第７条第２号の規定に違反して、同号に規定する営業所における専任技術者である者を同法第26条第１項に規定する主任技術者として工事現場に配置した。このことにより、営業所における専任技術者が、その営業所に常勤して専らその職務に従事すべきところを、一定期間、専任しているとは認めがたい状態にあった。 当該建設業者は、令和５年２月16日に行った令和４年９月30日を審査基準日とする経営規模等評価の申請において、請け負った民間発注の建設工事について、その施工が２事業年度に渡るため、その未完成工事に係る初年度の完成工事高（請負代金の額）を機械器具設置工事として記載し、主任技術者をA氏と、工期を令和４年２月から同年８月と記載した。 そして、令和６年２月９日に行った令和５年９月30日を審査基準日とする経営規模等評価の申請においては、同工事の次年度の完成工事高を、昨年とは異なる業種である管工事として、昨年と重複して請負代金全額であると記載し、監理技術者をB氏と、工期を令和４年9月から令和５年２月と記載した。 以上のとおり、当該建設業者は、建設業法第27条の26第２項及び第４項の規定に違反して、上記の二度の連続する経営規模等評価の申請において、事実と異なる建設業の業種について完成工事高を記載し、その全体の完成工事高に重複した額を上乗せした完成工事高を計上した。 そして、当該建設業者は、これにより得た経営事項審査結果を堺市に提出し、同市がその結果を管工事の公共工事（当該建設業者が落札）に係る資格審査に用いた。
