Cause of action

当該建設業者の取締役は、同社の業務に関し、令和３年４月19日、大阪府高槻市所在の木造２階建て住宅新築工事現場において、労働者を使用して、高さが６メートル25センチメートルの梁及び歩み板上で仮筋交い取付作業を行わせるに当たり、同所から墜落により労働者に危険を及ぼすおそれがあったが、同所は、同建物の柱及び梁の組み合わせが複雑であったため、足場を組み立てる等の方法により作業床を設けることが困難であったから、防網を張り、労働者に要求性能墜落制止用器具を使用させる等の措置を講じなければならないのに、その措置を講じず、もって労働者が墜落するおそれのある場所に係る危険を防止するために必要な措置を講じなかった。 このことで、同人は、労働安全衛生法（昭和47年法律第57号）違反により、罰金15万円の刑に処せられ、令和４年４月16日にその刑が確定した。
