有限会社浜野興業の役員は、同法人の安全管理を総括するものであるが、札幌市南区で実施した工事において、労働者をして、ドラグ・ショベルを用いて擁壁の裏側を掘削した溝に降り、スコップを用いて穴の深さや幅を微調整させる作業を行わせるにあたり、当該作業箇所は擁壁に近接する箇所における明かり掘削作業であり、当該擁壁が損壊することにより労働者に危険を及ぼす恐れがあったのであるから、同擁壁を補強し、移設するなどをし、損壊等による危険を防止する措置を講じなければならないにもかかわらず、その措置を講じず同作業を行わせた。 このことにより、労働安全衛生法第２１条第１項及び労働安全衛生規則第３６２条第１項に基づき、札幌簡易裁判所において、同法人及び同法人役員が罰金刑に処せられ、刑が確定した。 このことは、建設業法第２８条第１項第３号に該当するものである。
