The workers used a drag shovel to excavate behind the wall and used a shovel to fine-tune the depth and width of holes. The work site was near the retaining wall and involved light excavation, which could have damaged the wall and posed a danger to workers. The company did not reinforce or relocate the wall to prevent damage and did not implement safety measures before proceeding with the work. Consequently, under Article 21, Paragraph 1 of the Industrial Safety and Health Act and Article 362, Paragraph 1 of the Industrial Safety and Health Regulations, the company and its officers were fined by the Sapporo Summary Court, with the judgment becoming final. This violation falls under Article 28, Paragraph 1, Item 3 of the Construction Business Act.
