On July 13, 2021, an employee was injured when a steel channel fell onto his right foot during steel assembly work near the Toyonaka P36 pier on the Chugoku Expressway, resulting in fractures of the first, second, and third metatarsal bones and more than four days of leave. Despite this, A instructed a social insurance labor consultant unfamiliar with the facts to prepare a worker injury report falsely stating that the employee was injured by dropping scrap onto his foot at the company's warehouse in Hirano-ku, Osaka. The report was submitted and accepted by the Osaka South Labor Standards Inspection Office on November 18, 2021. Consequently, both the construction company and A were fined 200,000 yen each for violations of the Industrial Safety and Health Act, with the penalties finalized on October 11, 2023.

Cause of action

当該建設業者は、大阪市平野区に本店を置き、建築工事業を営み、三次下請として中国自動車道（特定更新等）吹田JCT～中国池田IC間橋梁更新工事（建設工事）の第一工区（豊中P33～P37）での工事を施工する事業者、Aは、当該建設業の代表取締役として官公庁の各種報告を含む当該建設業者の事業全般を統括管理するものであるが、A及び一次下請業者の従業員は、共謀の上、当該建設業者の業務に関し、真実は当該建設業者の労働者が令和3年7月13日、大阪府豊中市桜の町地内中国自動車道下り線の豊中P36橋脚付近において、鉄骨組立作業中に溝形鋼（別名チャンネル）が同人の右足上に倒れたことにより、右第１、２，３中足骨骨折等の障害を負い４日以上休業したのに、同人が同日に大阪市平野区内所在の当該建設業者の倉庫において、スクラップを右足に落として負傷した旨の虚偽の事実を記載した労働者死傷病報告書を、Aが、情を知らない社会保険労務士に依頼して作成させてこれを郵送させたうえ、同年11月18日同市西成区玉出中2丁目13番27号大阪南労働基準監督署において同署長に受理させ、もって労働基準監督署長に虚偽の報告をした。 このことで、当該建設業者及び当該建設業者の代表取締役であるAは、労働安全衛生法（昭和47年法律第57号）違反により、それぞれ罰金20万円の刑に処せられ、令和５年10月11日にその刑が確定した。
