株式会社アルバは、令和５年度に北九州市内の民間工事において、建設業法第３条第１項の許可を受けないで建設業を営む株式会社Zen内装及び杉山創建と、同法施行令第１条の２第１項で定める軽微な建設工事の範囲を超えて、下請契約を締結した。 また、株式会社アルバは、同工事において、建設業法第24条の８第１項及び第４項の規定に違反し、施工体制台帳及び施工体系図を作成しなかった。以上のことは、建設業法第28条第１項第２号及び第６号に該当する。
