株式会社アクセス横浜は、神奈川県秦野市堀西450番地の１に本店を置き、建設工事業を営む事業者、天野浩二は、同社の代表取締役（事件当時）として同作業所における業務及び官公庁に対する各種報告・届出等の業務を統括するものである。天野浩二は、同社の業務に関し、令和３年10月11日、神奈川県平塚市浅間町10番地22号所在の平塚労働基準監督署において、同署長に対し、真実は、同社の労働者Ａが、令和３年10月６日、神奈川県秦野市鶴巻北２丁目23番６号付近の、東名高速道路伊勢原管内維持修繕業務その１（2021年度）の現場で、就業中に、高速道路の上部で交差する橋へ高所作業車の作業床から乗り移ったところ、橋の高欄上部から橋に墜落し、休業見込み１か月を要する左手舟状骨骨折の傷害を負い、４日以上休業したにもかかわらず、「当日の業務終了後、車両置場にて車両の荷台の整理をしているときに、荷台から降りようとしたところ、バランスを崩して地面に転落し負傷した。」旨の労働者死傷病報告書を提出し、もって労働基準監督署長に虚偽の報告をした。 その結果、株式会社アクセス横浜及び同社の代表取締役（事件当時）が、小田原簡易裁判所から、労働安全衛生法違反で罰金20万円の略式命令を受け、令和４年11月25日にその刑が確定した。 このことは建設業法第28条第１項第３号に該当する。
