建設業の許可を受けないで建設業を営む株式会社アーバン・プロモーティングは、特定建設業者である元請人から軽微な民間工事を継続して請け負っていたが、建設業者との取引を望んでいた元請人から建設業の許可を取るよう求められた。 許可の要件を満たしていなかった同社は、元請人との取引を継続するため、他人の許可通知書の写しに改ざんを行い、あたかも真正な許可通知書を原形どおりに正確に複写したかのような形式・外観を有する写しを作成し、令和５年３月にその写しを提出することで元請人に許可業者であると誤信させて、以後、取引を増大させ、令和６年６月までの間に県内において約600件（約7,000万円）の軽微な工事を元請人に発注させるなど、請負契約の締結に当たり著しく不誠実な行為を行った。
