Considering that even in heavy rain, without construction, forests serve as natural barriers to prevent landslides, the construction company has an obligation to take sufficient measures to prevent sediment disasters during construction. The company violated permit conditions under Article 10-2, Paragraph 4 of the Forest Act (Act No. 249 of 1951) by cutting and altering forests outside the project area and within residual forest land, contrary to the forest land development permit. Additionally, the company failed to adequately strengthen temporary disaster prevention facilities and install sediment basins, leading to insufficient sediment runoff prevention measures. In July of Reiwa 6 (2024), heavy rains caused large quantities of sediment to flow outside the project area, damaging nearby rice fields and waterways, and causing harm to the public due to improper construction practices.

山口県下関市内の民間発注の工事（以下「本件工事」という。）は太陽光発電設備を設置するために森林を開墾する造成工事であるため、大雨であっても本件工事の施工がなければ森林が防御壁等となって土砂災害の発生が抑制されることを踏まえ、本件工事の施工にあたっては土砂災害防止のための十分な措置を講じる義務が当該建設業者にあるところ、当該建設業者は、本件工事において、森林法（昭和26年法律第249号）第10条の２第４項の林地開発許可の許可条件に違反して、事業区域外の森林の伐採や形質の変更、残地森林地内の森林の伐採や形質の変更などを行ったことに加え、仮設防災施設の強化や沈砂池の設置などの土砂流出防止措置が不十分であったため、令和６年７月に、大雨に伴い、土砂が事業区域外に大量に流出し、近隣の田んぼや水路などに被害が及ぶなど、建設工事を適切に施工しなかったために公衆に危害を及ぼした。
