鈴木建設有限会社代表取締役が、法定の除外事由がないのに、令和元年７月下旬頃から同年８月上旬までの間に、千葉市若葉区東寺山町５６１番出雲大社函館教会千葉総国講社敷地内において、廃棄物であるコンクリートがら等約１２．９３トンを土中に埋め、もってみだりに廃棄物を捨てたものである。 当該事実に基づき、千葉地方裁判所から令和４年５月２７日に廃棄物の処理及び清掃に関する法律違反により、法人が罰金５００万円、代表取締役が懲役２年（執行猶予３年）の刑に処せられた。 このことが、法第２８条第１項第３号及び同条第３項に該当すると認められる
