被処分者は、唯一の専任の宅地建物取引士（以下「専任取引士」という。）が令和７年１月29日に退職した翌日から、約11か月間、専任取引士が不在の状態にあったにもかかわらず、必要な措置を執らなかった。このことは、法第31条の３第３項の規定に違反し、業務停止処分に該当するが、専任取引士が不在の間は契約等の業務を行っておらず、関係者の損害が発生していないこと、かつ、是正措置を執ったことから今後も関係者の損害が発生することが見込まれないことから、指示処分とする。
