株式会社小林建設の元代表取締役は，東広島市において工事の設計，積算等に使用していた広島県内の工事資材に関する単価表の情報を提供してもらう有利かつ便宜な取り計らいを受けたい旨の請託をし，その請託の趣旨に従って情報を提供したことに対する謝礼として，元東広島市職員に対し現金を供与し，もって同人の職務に関して賄賂を供与した。このことにより，同社の元代表取締役は，広島地方裁判所から刑法第198条(贈賄)違反による懲役10か月(執行猶予３年)の判決を受け，令和４年３月11日にその刑が確定した。このことが，建設業法第28条第１項第３号に該当する。
