株式会社北岡工務店が県に提出した書類の記載によると、建設業法第26条第３項及び建設業法施行令第27条により専任の主任技術者等の配置が義務付けられている民間発注の建築一式工事に、建設業法第７条第２号に規定される営業所の専任技術者を主任技術者として配置していたことが判明した。 このことは、建設業法第26条第３項に違反し、同法第28条第１項第２号に該当すると認められる。 注 本件違反行為は、現行の建設業法が、令和６年12月13日に施行される以前のものであるため、「営業所技術者」ではなく、旧法下の「営業所の専任技術者」と呼称する。
