株式会社谷内組の元取締役は、令和２年５月に金沢市が実施した「にし茶屋街緑地整備工事（土木工事）」の一般競争入札において、同市土木係長に賄賂を供与し、共謀の上、本件工事の最低制限価格の教示を受けて同金額で落札し、もって偽計を用いて公の入札で契約を締結するためのものの公正を害すべき行為を行った。 これにより、元取締役は令和３年１２月２２日に金沢地方裁判所から懲役１年６月（執行猶予３年）の判決を受け、令和４年１月６日にその刑が確定した。 このことは、建設業法第２８条第１項第３号に該当すると認められる。
