森松工業株式会社の元西日本水道営業統括（当時、政令で定める使用人）及び元関西水道営業部大阪支店社員２名は、共謀の上、兵庫県赤穂市元職員に対し、同市が令和2年6月26日に入札を執行した「御崎配水池整備工事」及び令和3年度に発注が見込まれる「(仮称)北野中浄水場第１系浄水池更新工事」に関し、各工事で設置の配水池タンク等の特記仕様書等の内容を同社の製品の仕様のものに差し替えてもらうなど有利かつ便宜な取り計らいを受けたい旨の趣旨の下に賄賂を供与した。 このことにより、令和3年6月28日に神戸地方裁判所より、同社の元西日本水道営業統括ほか２名は、それぞれ刑法第198条（贈賄）による懲役１年 （執行猶予３年）の判決を受け、この刑が確定している。 このことが、建設業法第28条第１項第２号及び第３号に該当すると認められる。
