当該建設業者が、道路交通法（昭和35年法律第105号）違反により、懲役10月に処せられ、平成25年12月18日にその刑が確定するとともに、同法違反により懲役４月の刑に処せられ、平成28年１月14日にその刑が確定した。さらに同法違反により懲役６月の刑に処せられ、令和元年６月３日にその刑が確定した。 また、当該建設業者が平成30年１月18日に提出した建設業法第５条の許可申請書及び同法第６条第１項の書類に、同人が欠格要件に該当しないとの虚偽の内容を記載し、同年１月20日に同法第３条第３項の許可の更新を受けた。
