新潟県上越市板倉区別所地内の主要地方道上越飯山線１年災道路復旧工事において、同工事を請け負った株式会社勇和工業の役員は、現場責任者として施工全般を統括し、労働者の安全管理等を行うとともに、自ら同工事に従事していた。 令和２年７月30日、同工事現場において、同役員は法定の資格を有していないにも拘わらず、擁壁上部でブロックの移動作業を行うにあたり、機体重量３トン以上のドラグショベルの運転業務を行ったところ、擁壁上部から約５メートル下にドラグショベルが転落し、擁壁の下で目地補修作業をしていた下請負人の労働者が負傷する労働災害を発生させた。 このことを原因とし、労働安全衛生法違反により、同役員は高田簡易裁判所から罰金50万円の略式命令を受け、令和３年５月18日にこの刑が確定している。 このことが、建設業法第28条第１項第３号に該当する。
