株式会社小山水道建設の代表取締役は、同社の業務に関し、令和５年10月18日、東京都町田市南成瀬５丁目12番地先から同市南成瀬６丁目12番地先間の配水小管布設替工事現場内において、同社の労働者が、ダンプカーの荷台上でアスファルトの集積作業中、同荷台上から地面に落下して外傷性頸部症候群等の傷害を負い、４日以上休業したのであるから、遅滞なく、労働者死傷病報告書を所轄の八王子労働基準監督署町田支署長に提出して報告しなければならなかったのに、令和６年６月18日に至るまで同報告書を提出せず、もって遅滞なく法令で定める報告をしなかった。 このことにより、同社と同社代表取締役に対し、労働安全衛生法違反で罰金20万円の罰金刑が確定した（町田簡易裁判所 令和７年７月25日略式命令）。 このことは、建設業法第28条第１項第３号に該当する。
