令和4年2月9日、長岡組が請け負った伊都郡高野町細川地内の国道370号道路改良工事現場において、車両系荷役運搬機械である不整地運搬車を用いて土砂の運搬及び積み降ろし作業を行わせるに当たり、あらかじめ、当該作業に係る場所の広さ及び地形、当該車両系荷役運搬機械等の種類及び能力、荷の種類及び形状等に適応する作業計画を定め、かつ、当該作業計画により作業を行わせなければならないのに、これを定めずに作業を行わせ、もって機械等による危険を防止するために必要な措置を講じなかった。これにより、代表者は労働安全衛生法に違反し、他法令違反と併せて罰金刑に処せられ、その刑が確定している。このことは、建設業法第28条第1項第3号の規定に該当すると認められる。
