東洋テクノ株式会社が、注文者から一次下請けとして請け負った北海道山越郡長万部町における北海道新幹線、中ノ沢高架橋工事において、令和６年３月２０日に労働者１名が死亡する事故が発生した。 この件について、労働者に貨物自動車に積載された鉄筋かごの荷卸し作業を行わせるに当たり、一の荷でその重量が１００キログラム以上のものを貨物自動車から卸す作業を行うときは、当該作業を指揮する者を定め、その者に、作業手順及び作業手順ごとの作業方法を決定し、作業を直接指揮すること等を行わせなければならないのに、これを定めることなく作業を行わせ、もって荷役業務における作業方法から生ずる危険を防止するため必要な措置を講じなかったとして、令和８年３月１３日、八雲簡易裁判所から同社及び同社の社員１名が労働安全衛生法違反で略式命令（いずれも罰金２０万円）を受け、その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
