和田長建設株式会社は真岡市（以下、「市」という。）が発注した建設工事に関し、従前の建設業許可が建設業法第12条に規定する廃業届の提出により無効であることを認識しながら、その無効な許可通知書を確認書類として提示したことにより、市側の判断を誤らせ、無許可の状態で公共工事を請け負った。 また、新たに建設業の栃木県知事許可を受けた後も、建設業法第27条の23に規定する経営事項審査を受けることなく、市が発注した建設工事を繰り返し請け負った。 これらの事実は、建設業法第28条第１項第２号及び同条第２項第２号に該当すると認められる。
