有限会社星野外構及び同社の代表取締役は、同社の業務に関し、平成30年６月７日、新潟県阿賀野市内の空き地において、廃棄物である樹木の枝葉等約156キログラムを焼却したことが、廃棄物の処理及び清掃に関する法律に違反するとして、令和元年９月10日に新発田簡易裁判所から、同社は罰金100万円、同社の代表取締役は罰金50万円の判決を受け、その刑が確定している。 このことが、建設業法第28条第１項第３号に該当する。
