有限会社中川基礎工業は、令和７年５月13 日、北海道北広島市の工事現場において、車両系建設機械であるドラグ・ショベルを用いて地面の掘削作業を労働者に行わせていたところ、当該ドラグ・ショベルが法面から転落し、運転していた同労働者が死亡した労働災害において、車両系建設機械の転落等による労働者の危険を防止するために、地形、地質の状況等の調査に より知り得たところに適応する作業計画を定めなかった。 このことにより、労働安全衛生法第20 条第１号及び労働安全衛生規則第155 条第１項に違反し、札幌簡易裁判所において、同社及び同社役員が罰金刑に処せられ、刑が確定した。 このことは、建設業法第２８条第１項第３号に該当するものである。
