猪又建設（株）の元営業部長は、糸魚川市が令和２年１２月８日に入札を執行した「建補第10号新駅公衆トイレ整備工事」の制限付き一般競争入札に関し、糸魚川市元係長と共謀の上、市元係長から、本件工事の入札に関する秘密事項である予定価格等の教示を受け、よって、同年１２月８日に執行された本件工事の入札において、同社をして、教示された予定価格に近似した価格で入札させて落札させ、もって偽計を用いて、公の入札で契約を締結するためのものの公正を害すべき行為を行った。 これにより、元法人営業部長は、刑法第６０条及び同法第９６条の６第１項（公契約関係競売等妨害）に該当し、令和３年８月２７日に懲役１年（執行猶予３年）の判決を受け、同年９月１１日にその刑が確定した。 このことが、建設業法第２８条第１項第２号に該当すると認められる。
