初島電設株式会社は、和歌山県発注工事の施工に際して、建設業法（昭和24年法律第100号）第19条第1項の規定に定める義務を怠り契約書を作成しないまま一部下請負業者に工事を施工させた。 また、同社は、公共工事の入札及び契約の適正化の促進に関する法律（平成12年法律第127号）第15条第1項の規定により読み替えて適用される建設業法第24条の8第4項の規定に定める施工体系図を同工事の現場の工事関係者が見やすい場所及び公衆が見やすい場所に掲げることを怠ったまま工事を施工していた。 さらに、同社は建設業法第40条の規定に定める標識を同工事の現場に掲示することを怠ったまま工事を施工していた。 このことは、建設業法第28条第1項本文の規定に該当すると認められる。
