However, from mid-August 2021 onward, the company’s management supervisor rarely visited the office in Takahama, Shimamoto Town, Mishima District, or the office in Kyoto City, Kyoto Prefecture, and did not meet the standards specified in the law. 3. The office located in Kyoto City, Kyoto Prefecture, which had a fixed telephone, photocopier, signboard, and construction permit notification, and employed staff, was recognized as an office under Article 3 of the Act. １． 当該建設業者は、令和２年８月18日に三島郡島本町江川に営業所を設けて営業をしようとして大阪府知事より建設業法第３条の許可を受けたが、令和３年８月に同営業所を退去させられ、京都府京都市内に拠点を設けた。同年10月に三島郡島本町高浜の他人が賃借する住居の１階奥の１間を使用貸借する契約を同人と締結したものの、その１間には固定電話等が設置されておらず、同法第40条の標識も掲げられておらず、一時、ポストを設けていたものの賃貸人の許可を受けることができないなど営業所として使用する権原もなかった。このように、同１間は、営業所の要件を備えないため、同法第３条の営業所に当たらないものであった。すなわち、令和３年８月の営業所退去後、当該建設業者は、大阪府内に同法第３条の営業所を設けていない状態があった。 大阪府内に建設業法第３条の営業所がないため、当該建設業者は、同法第７条第２号に規定する営業所の専任の技術者を置くことができず、当該技術者が上記の１間に常勤して専ら職務に従事することもなく、同号に掲げる基準を満たしていなかった。 ２． 当該建設業者の建設業法第７条第１号に規定する経営業務の管理責任者は、原則として本社、本店等において休日その他勤務を要しない日を除き、一定の計画のもとに、毎日所定の時間中、その職務に従事する必要があるにも関わらず、令和３年８月中旬以後、三島郡島本町高浜又は京都府京都市所在の事務所にはほとんど行っておらず、同号に掲げる基準を満たしていなかった。 ３． 京都府京都市所在の事務所には、固定電話、複写機、表札、建設業の許可通知書等があり、従業員も居たことから、同所は建設業法第３条の営業所である。よって、当該建設業者は、１のとおり大阪府の区域内における営業所を廃止して、京都府の区域内に営業所を設置しなければならないこととなったが、京都府知事の許可を受けなかった。
