株式会社秋田電工は、平成７年１０月１６日の法人設立と同時に、本社の他、大館・秋田・本荘・大曲・横手・湯沢の各営業所を設置し、それぞれの営業所が常時建設工事の請負契約を締結する事務所として認められる状態にありながら、大館・秋田・本荘・大曲の各営業所については令和元年１２月まで、横手営業所については令和３年１１月まで、湯沢営業所については廃止するまで、建設業法第１１条に規定されている届出をせず、建設業法上の営業所等として認められていない状態のままで複数の建設工事の請負契約を締結した。 また、大館・秋田・本荘・大曲の各営業所については令和元年１０月まで、横手営業所については令和３年９月まで、湯沢営業所については廃止するまで、営業所の専任技術者を配置していなかった。 このことは、建設業法第１１条第１項及び第７条第２号に違反し、同法第２８条第１項本文に該当するものと認められる。
