（株）村田組が請け負った大阪市港区弁天1丁目1番先所在の工事現場において、令和2年1月7日、同社の労働者がバックホウの扉に指を挟み、左拇指切断の傷害を負い4日以上休業したのに、同社は同人が同日、兵庫県伊丹市桑津3丁目217番3所在の同社資材置き場においてバックホウの調整中に前記傷害を負った旨の虚偽の事実を記載した労働者傷病報告書を同月23日、伊丹労働基準監督署長に提出したことにより、令和3年5月26日付けで労働安全衛生法違反として伊丹簡易裁判所から罰金刑の略式命令を受け、その刑が確定している。 このことが、建設業法第28条第1項第3号に該当すると認められる。
