令和４年９月２１日、茨城県那珂郡東海村白方１－１所在の東海第２発電所防潮堤工事現場において、労働者が型枠作業中に、落下した円柱状の型枠を固定する部材が左肘に当たり左橈骨頭を不全骨折し、４日以上休業したのであるから、遅滞なく、労働者死傷病報告書を所轄の水戸労働基準監督署署長に提出して報告しなければならなかったのに、令和５年１２月８日に至るまで同報告書を提出せず、もって遅滞なく法令の定める報告をしなかったものである。 当該事実に基づき、水戸簡易裁判所から令和７年５月２１日付け(令和７年６月１０日に刑が確定した)令和７年（い）第１２８号略式命令において、労働安全衛生法違反により取締役重久晃が罰金２０万円の刑に処せられた。このことが建設業法第２８条第１項第３号に該当すると認められる。
